At Ranges Australia (ACN: 604 585 891) (“we”, “us”, “our”), we are committed to providing reliable digital infrastructure, platforms, products, and media development services under our sub-brands (Ranges Technology, Digital, Media).
This Acceptable Use Policy (AUP) outlines the responsible use of our services to ensure security, performance, and compliance with Australian laws.
This AUP applies to all users (“you”, “your”) of our services, including web/email hosting, domain reselling, DNS management, software/plugin reselling, website maintenance/security, content development, strategic consulting, and media projects under our sub-brands.
It supplements our Master Services Agreement (MSA) and sub-brand Service Agreements. By using our services, you agree to comply with this AUP. Violation may result in suspension, termination, or legal action.
We encourage fair, lawful use that supports your business growth. If unsure about compliance, contact us via our website before proceeding.
Scope of Services Covered
This AUP applies to all services provided by Ranges Australia, including but not limited to:
Ranges Technology: Website and app hosting, email hosting, domain reselling, DNS hosting and management, software and plugin reselling, website maintenance and security services.
Ranges Digital: Website building and management, content development, strategic consulting.
Ranges Media: Media development, project delivery.
Prohibited Uses
You must not use our services for any activity that is illegal, harmful, disruptive, or excessive. Prohibited uses include, but are not limited to:
Illegal Activities
Any use violating Australian federal, state, or territory laws, including:
- Criminal Code Act 1995 (Cth) (e.g., child exploitation material, promoting terrorism, fraud).
- Copyright Act 1968 (Cth) (e.g., unauthorised distribution, copying, or modification of copyrighted material).
- Trade Marks Act 1995 (Cth) (e.g., trademark infringement).
- auDA Rules for .au domains (e.g., domain leasing to third parties, failing Australian presence requirements).
Hosting or developing content that promotes violence, discrimination, or illegal gambling.
Spam and Unsolicited Communications
Sending unsolicited commercial electronic messages (spam) in breach of the Spam Act 2003 (Cth), including:
- Bulk emailing beyond basic business needs (e.g., newsletters to unsubscribed lists).
- Automated messaging or scraping for marketing without consent.
We use dedicated Individual Service Agreements (ISAs) for legitimate bulk emailing and electronic broadcast marketing services.
Malicious or Harmful Activities
Distributing viruses, malware, ransomware, trojans, or other harmful code.
Engaging in phishing, hacking, denial-of-service (DoS/DDoS) attacks, or network scanning/probing.
Attempting to bypass security measures, filters, or access controls (e.g., spam/virus protection on email hosting).
Resource Abuse and Excessive Use
Excessive or “spiky” consumption of server resources that impacts other users or our infrastructure, including:
- Cryptocurrency mining or similar compute-intensive tasks.
- Sustained high CPU, memory, RAM, or I/O usage on shared hosting (e.g., from high-traffic bots or scraping).
- Unlimited bandwidth/storage used for file sharing, backup servers, or torrenting (use dedicated ISAs for cloud storage/backup).
- Running applications unsuitable for shared environments (e.g., game servers, proxy services).
Inappropriate or Offensive Content
Hosting, developing, or distributing content that is:
- Defamatory, harassing, libellous, or invasive of privacy.
- Discriminatory, obscene, pornographic, or promoting hate speech.
- Misleading or deceptive (e.g., false advertising violating ACL).
Intellectual Property Infringement
Uploading, hosting, or developing content that infringes third-party intellectual property rights without authorisation, including:
- Pirated software, music, videos, or images.
- Unauthorised use of trademarks, logos, images or copyrighted designs in website/content development.
Network and Infrastructure Interference
Interfering with our services or third-party networks, including:
- Port scanning, vulnerability testing, or unauthorised access.
- Using our DNS management or hosting for spam relays or botnets.
Other Prohibited Activities
Any use that could harm our reputation, violate privacy laws (e.g., unauthorised data collection), or expose us to legal liability.
Reselling services without our written consent (except authorised domain/software reselling).
Impersonating others or misrepresenting your affiliation with Ranges Australia.
For media development and content services (Ranges Media/Digital), all created materials must comply with these prohibitions—e.g., no unlawful content in videos, graphics, or websites.
Enforcement and Consequences
We reserve the right to monitor service usage reasonably (as permitted by our Privacy Policy and Australian Privacy Principles) to detect and prevent violations. Monitoring may include automated tools (e.g., server logs, traffic analysis) and manual reviews upon complaints.
If we identify or receive credible reports of a violation:
Investigation: We will investigate promptly and may contact you for clarification.
Notice and Remedy: For non-severe issues, we provide reasonable notice (e.g., 48 hours) to remedy the breach (e.g., remove content).
Actions: We may take one or more of the following, at our discretion:
- Temporary suspension of affected services (e.g., email access for spam).
- Permanent termination of services or accounts.
- Throttling bandwidth or resources.
- Charging administrative fees for investigation/remediation (e.g., at our Current Hourly Rate).
Severe Breaches: For illegal activities, malware distribution, or immediate threats, we may suspend or terminate without notice.
Indemnity: You agree to indemnify us against all losses, claims, damages, or expenses arising from your violation (as per MSA/ISAs).
Cooperation: We will cooperate with law enforcement or regulatory authorities as required.
You may appeal enforcement actions by raising a support ticket via our Support Portal (https://my.ranges.support) within 7 days. We will review in good faith and respond within 5 business days.
Reporting Violations
If you suspect a violation of this AUP (by yourself or others), report it immediately to us via our website or our support portal.
We treat reports confidentially and investigate promptly. False reports may result in consequences for the reporter.
Updates to the AUP
We may update this AUP from time to time to reflect changes in our services, laws, or technology.
Updates will be posted on our website (https://ranges.au/aup) with at least 30 days’ notice via email or Client Portal.
Continued use of our services after the effective date constitutes acceptance of the updated AUP.
If you object to material changes, you may terminate your services without penalty within 30 days of notice (per MSA/ISAs termination provisions).
Governing Law
This AUP is governed by the laws of Victoria, Australia.
Disputes will be resolved per the MSA/RTSA dispute resolution processes.
